Donald Trump (Donald Trump), the trade representative of the president, asked for further details about how low cost imported solar panels bracket related products could hurt American manufacturers to elaborate on whether to impose solar tariffs.
In a letter, Rodgers, the US Trade Representative (Lighthizer), asked the US International Trade Commission to submit a report on Monday, to help the president take "appropriate and feasible actions" to support domestic solar panel manufacturers.
In November, the Trade Commission recommended that the U.S. government impose a maximum of 35% tariffs on imported solar panels to help American manufacturers compete. Before, Suniva Inc., a bankrupt solar panel maker, submitted a trade complaint, saying it was strangled by foreign competitors. Trump has a final decision on setting tariffs.
Lighthizer specifically asked the Trade Commission to identify any "unforeseeable developments" that caused American companies to be hurt.
Suniva's trade complaint is based on a law that gives the president a wide collection of tariff powers. However, when the regulations are challenged by the WTO, the United States always loses. Trade analysts point out that the key issue is that the law is not consistent with the United States' obligations to WTO. For example, if we want to win a lawsuit in WTO, we must show a foreign competition that cannot be reasonably foreseen, while the US law only requires the company to prove that they are injured.
Packard says the White House's request for more information may also be the reason it seeks no tax.
Most solar industries are opposed to tariffs, as it slows the installation speed and causes thousands of people to be unemployed. Influential conservatives and free trade groups are also opposed to taxation. If the Trade Commission can't point out any unforeseeable situation, Trump may have an easy reason to say no to Suniva.
"If they are looking for some ways to get rid of the problem," Packard said, "that might be their best choice."
